Terms of Service

By purchasing artwork, prints, or commissioning custom artwork from Artbykhushh (“Artist”, “we”, “our”, “us”), you agree to the following Terms of Service.


1. Products & Services


Artbykhushh offers:

  • Original handmade paintings
  • Fine art prints and reproductions
  • Custom commissioned artwork
  • Limited-edition products as announced

All artwork is handmade and may contain slight variations, imperfections, or differences in color due to screen settings and the nature of handcrafted work.



2. Pricing & Payments


  • All prices are listed in the currency specified at checkout.
  • Full payment is required before artwork is shipped unless otherwise agreed in writing.
  • For custom commissions, a non-refundable deposit of may be required before work begins.
  • Prices may change without prior notice.


3. Custom Commission Policy


Consultation

Clients must provide clear project requirements, including size, medium, color preferences, reference images, and deadlines.


Approval Process

Progress updates may be shared during the creation process. Minor revisions may be accommodated at the Artist’s discretion.


Changes to the Brief

Significant changes requested after work has commenced may incur additional fees and extend delivery timelines.


Artistic Interpretation

While every effort is made to meet client expectations, the final artwork remains the Artist’s creative interpretation of the agreed concept.



4. Production & Delivery Timelines


  • Estimated completion times for custom artwork are provided as guidance only.
  • Delays due to workload, material availability, weather conditions, courier issues, customs clearance, or unforeseen circumstances may occur.
  • The Artist is not liable for delays beyond reasonable control.


5. Shipping & International Orders


  • Orders are shipped worldwide where available.
  • Shipping fees are calculated separately unless stated otherwise.
  • Buyers are responsible for providing accurate shipping information. 
  • In almost all shipments, we make sure that the buyer doesn’t incur additional charges upon receiving their order. However, international buyers are solely responsible for any customs duties, import taxes, VAT, brokerage fees, or other charges imposed by their country.
  • Delivery times vary by destination and customs processing.


6. Risk of Loss


Ownership and risk transfer to the buyer once the package has been handed over to the shipping carrier.

If an item arrives damaged, customers must contact us within 48 hours of delivery and provide photographs and videos of:

  • The damaged artwork
  • Packaging materials
  • Shipping label


7. Returns & Refunds


All sales are final and non-refundable. 


Refunds will not be issued for:

  • Change of mind
  • Incorrect address provided by the buyer
  • Delays caused by shipping carriers or customs authorities

However in the unlikely event where an item arrives damaged, customers must contact us within 48 hours of delivery and provide photographs and videos of the damaged artwork, packaging materials, and shipping label. Percentage compensation in this event will be determined by the Artist in accordance to the extent of damage but will not be more than 50% in any case. Claims submitted after 48 hours will not be eligible for any compensation.



8. Intellectual Property


All artwork, images, designs, photographs, and content created by Artbykhushh remain the intellectual property and copyright of the Artist unless otherwise agreed in writing.

Purchasing artwork does not transfer copyright ownership.

Buyers may:

  • Display purchased artwork for personal use
  • Share photographs of purchased artwork with proper credit

Buyers may not:

  • Reproduce, distribute, sell, modify, or commercially exploit the artwork
  • Create prints, merchandise, NFTs, or digital reproductions without written permission


9. Promotional Use


Unless otherwise agreed, the Artist reserves the right to photograph, display, and promote completed artworks, including commissioned pieces, on websites, social media platforms, portfolios, exhibitions, and marketing materials.

Clients requesting confidentiality must notify the Artist before work begins.



10. Limitation of Liability


To the maximum extent permitted by law, Artbykhushh shall not be liable for indirect, incidental, special, or consequential damages arising from the purchase, use, delivery, or inability to use any artwork or service.



11. Force Majeure


The Artist shall not be liable for delays or failures caused by circumstances beyond reasonable control, including natural disasters, pandemics, labor disputes, transportation disruptions, government actions, or supplier shortages.



12. Governing Law


These Terms shall be governed by and interpreted in accordance with the laws of India, without regard to conflict-of-law principles.
